Can You Buy a FSBO With a REALTOR®?

If you’ve spent more than a few days looking at homes for sale in Jasper and the surrounding communities, you’ve most likely seen at least a handful of houses listed as FSBO (that’s short for For Sale By Owner). But what if you’re working with a REALTOR® and you find a FSBO you really like – can you still buy it? This guide explains. 

Can You Buy a FSBO With a REALTOR®?

Before you read any farther, you should know that you should never buy a home without working with a buyer’s agent. Your REALTOR will be there to help you every step of the way – and they’ll save you a lot of time and money. That’s true whether you’re buying a FSBO home or one that’s on the conventional real estate market. 

You have nothing to lose by working with a REALTOR to buy a FSBO home (or any home, for that matter). Sellers typically pay real estate agents’ commissions; buyers don’t. That means someone’s in your corner, helping you without costing you a dime.

But when it comes to FSBO homes, you need to know that many sellers take that route so that they don’t have to pay a real estate agent’s commission. And some REALTORS don’t want to work with FSBO sellers, because they often end up doing the work the seller’s agent would have done (if the seller had hired an agent, that is) as well as their own work. 

Though some FSBO sellers don’t want to pay real estate commissions, some are happy to pay buyers’ agents for bringing them a sale. You should talk to the seller and find out whether they’re willing to pay your agent’s commission (or you can let your REALTOR handle it for you).

One thing to remember, though, is that you and the seller are liable for anything that goes wrong with the transaction. One of the main reasons people hire REALTORS is that there are so many legal forms that need to be filled out properly and filed; there are also precautions that agents take to protect their clients from unscrupulous parties and bad deals. If you’re going to buy a FSBO without a real estate agent on your side, you should hire a real estate attorney to help protect your interests. That way, you can at least keep yourself on the right side of the law.
